What are the different types of Power of Attorney and when should each be used?

 There are several types of Power of Attorney (POA), each designed for specific legal and personal situations. Choosing the correct type is essential because each grants different levels of authority and duration of control.

The most common type is the General Power of Attorney, which gives broad powers to the agent. This may include managing finances, handling business operations, buying or selling property, and dealing with legal matters. It is typically used when a person needs someone to manage multiple affairs on their behalf, often during extended travel or absence.

A Special or Limited Power of Attorney is more restricted in nature. It authorises the agent to perform only specific tasks, such as selling a particular property, managing a single bank account, or completing one legal transaction. Once the task is completed, the authority usually ends automatically.

The Durable Power of Attorney is particularly important in long-term planning. Unlike other types, it remains valid even if the principal becomes mentally incapacitated. This makes it essential for healthcare planning, elderly care, or situations involving serious illness. It ensures continuity in decision-making when the principal cannot express their wishes.

On the other hand, a Non-Durable Power of Attorney automatically ends if the principal becomes incapacitated. It is generally used for short-term or temporary purposes, such as authorising someone to handle financial matters while the principal is travelling abroad.

In some legal systems, there is also a Medical Power of Attorney, which specifically allows the agent to make healthcare decisions on behalf of the principal if they are unable to do so themselves.

Selecting the correct type depends on the level of control required, the duration of authority, and the level of trust between the principal and agent. Proper legal advice is often recommended to ensure the POA aligns with the intended purpose and avoids future legal complications.
